Description: (emergency repair) street cut to be determined at end of job. permitting the installation of fiberoptic lines into existing conduit owned by swbt at locations as noted in situs address fields. in the event any excavation must be made during this installation additional excavation permits must be obtained from kcmo public works. obtaining this permit implies agreement between city of kansas city missouri and swbt. which is attached as addendum to permit or as follows on kiva screen:. unlike telecommunications providers operating their own system in conjunction with the installation of conduit in the public right of way axon telecom has installed empty conduit within the city. axon telecom now wishes to install fiber and lease dark fiber to a telecommunications provider(s). installation of this fiber in an existing duct bank necessitates some disruption to the public rights of way. axon telecom is occupying the right of way as a result of a temporary agreement between axon telecom and the city. axon telecom and the city must resolve the question of appropriate conditions on axon telecom's occupancy of the right of way as well as appropriate compensation to the city for axon's use of the right of way to provide facilities to telecommunications companies. upon acceptance of this permit to install dark fiber in the conduit placed within the city's right of way the city and axon telecom will expeditiously meet and negotiate appropriate terms for the special occupancy of the right of way by axon telecom including the occupancy allowed by this special permit. this permit is issued as a convenience to axon telecom and will not be reissued for additional installations. the expeditious resolution of appropriate lease / license terms for axon telecom's occupancy of the right of way will permit additional installations in a reasonable time. issuance of this permit is not an admission by the city of its agreement or assent to any action taken by axon telecom to gain entry to the rights of way of the city and its subsequent occupancy of the rights of way. axon telecom will obtain all other permits such as street closure and excavation permits if otherwise required by ordinance. as part of this special permit axon telecom will provide to the city the name address telephone number and official of the contractor or of axon telecom responsible for the installation of the new fiber; the name address telephone number and official of axon telecom responsible for this project; and name address and telephone number of the any lessee of the fiber prior to the delivery of any installed fiber for use by said lessee. the purpose of this requirement is to insure appropriate occupational license taxes are paid by the users of the rights of way including those telecommunications companies leasing fiber for their facilities-based operations and to insure the city knows who is occupying the public right of way. axon telecom will maintain insurance required for the installation of the conduit naming the city as an additional insured for any operations performed by axon to lease or maintain the fiber. an insurance certificate naming the city as an additional insured to an insurance policy carried by the any lessee of the fiber may substitute for this insurance. the intent of this requirement is to insure that any activity undertaken by any private party in the public rights of way does not subject the citizens of kansas city to any risk of liability for the actions of the private party in the rights of way. this permit does not grant any rights to any third party including the any lessee of the fiber. this permit does not grant axon or the any lessee of the fiber permission to install any equipment other than the fiber requested. acceptance of this permit is proof of axon telecom's agreement to these terms and conditions. acceptance of this permit is evidenced by the signature of an official or agent of axon telecom authorized to act for axon telecom.
